TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Stella Sacrum website and your purchase of products from Stella Sacrum (“Stella Sacrum,” “we,” “us,” or “our”).
By accessing our website, placing an order, or purchasing a product from Stella Sacrum, you agree to these Terms and to any policies incorporated herein, including our Return & Refund Policy, Shipping Policy, and Privacy Policy.
1. STELLA SACRUM
Stella Sacrum specializes in antique and vintage jewelry, antique components, and one-of-one jewelry created, reconstructed, converted, or assembled using antique and vintage components.
Our inventory may include antique gold and sterling silver chains, Albert chains, bracelets, extenders, clasps, dog clips, bolts, pendants, fobs, intaglios, rings, gemstones, and other collectible jewelry.
Many Stella Sacrum pieces are unique and cannot be replaced with an identical item.
2. ANTIQUE & VINTAGE CONDITION
Antique and vintage jewelry has been previously owned and may be decades or more than a century old.
Unless expressly stated otherwise, such items are sold in their existing antique or vintage condition.
Normal characteristics may include patina, surface wear, scratches, minor dents, irregularities, variations in finish, evidence of previous wear, historic repairs, solder marks, replacement components, wear to hallmarks, and other age-related characteristics.
These characteristics are inherent to antique and vintage jewelry and do not, by themselves, constitute defects.
We make reasonable efforts to photograph and disclose material condition issues known to us. Customers should review all photographs, videos, measurements, descriptions and condition information before purchasing.
Antique and vintage jewelry should not be expected to meet the manufacturing tolerances, appearance or condition of newly manufactured jewelry.
3. ONE-OF-ONE, RECONSTRUCTED & CONVERTED JEWELRY
Certain Stella Sacrum pieces are original one-of-one compositions created using antique or vintage jewelry components.
Such pieces may have been reconstructed, converted, shortened, lengthened, combined, soldered, modified or assembled into a new configuration.
When a piece incorporates antique components, a historical designation such as Victorian, Edwardian, Georgian or another period may describe the relevant antique component and does not necessarily mean that the finished present-day configuration was created during that historical period.
Where reasonably known, Stella Sacrum will identify significant modern alterations or additions.
4. DESCRIPTIONS, DATING, HALLMARKS & ATTRIBUTION
We make reasonable good-faith efforts to accurately describe every item.
Descriptions concerning metal content, hallmarks, maker’s marks, dates, historical periods, origin, construction, gemstones and other characteristics may be based upon visible hallmarks, testing, construction techniques, stylistic characteristics, provenance, prior seller information, professional opinions and other reasonably available evidence.
Unless expressly accompanied by an independent certificate, assay or laboratory report identified in the listing, statements regarding age, maker, origin, gemstone identity, carat weight or historical attribution represent our good-faith assessment and are not represented as independent laboratory certification.
Photographs of hallmarks may form part of the product description. Customers are encouraged to examine them before purchase.
Nothing in this section limits any representation or warranty that cannot legally be excluded.
5. GEMSTONES & DIAMONDS
Unless expressly supported by an independent gemological report referenced in the listing, gemstone and diamond identification, estimated carat weight, color, clarity, treatment status, origin and other characteristics may be approximate.
Antique gemstones frequently exhibit irregular cutting, asymmetry, inclusions, abrasions, chips, wear and other characteristics consistent with their age and historical manufacture.
Descriptions such as Old Mine Cut, Old European Cut, rose cut or similar terminology describe our good-faith assessment of the apparent cutting style unless otherwise certified.
6. WEIGHTS, DIMENSIONS & SIZING
Weights and measurements are provided as accurately as reasonably possible but may be approximate.
Small variations may result from measuring instruments or measurement methods.
Bracelets may be described using both flat length and approximate wearable circumference. Because wearable circumference varies according to link thickness, construction and clasp configuration, a bracelet’s flat measurement does not necessarily equal its wearable circumference.
Ring sizing may also be approximate, particularly for antique rings or unusual shank designs.
Customers are responsible for reviewing measurements and determining whether an item is appropriate for their intended use before purchasing.
7. PHOTOGRAPHS & VIDEOS
We make reasonable efforts to photograph our jewelry accurately.
Color, tone, scale and appearance may vary due to lighting, photography, magnification, screen calibration and device settings.
Images may be enlarged or photographed closely to show detail. Customers should rely on the measurements stated in the listing when assessing actual physical size.
Unless expressly stated otherwise, chains, pendants, charms, boxes, displays, clothing, props and other styling accessories appearing in photographs are not included in the sale.
8. PRICES & CURRENCY
Prices are displayed in the currency identified on the website.
Customers are responsible for reviewing the currency and total purchase price before completing checkout.
Prices may change without notice before an order is accepted.
We reserve the right to correct genuine typographical, technical, inventory or pricing errors. If a material error is discovered after an order has been submitted, we may contact the customer and, where permitted by applicable law, cancel the transaction and issue a full refund.
9. ORDERS & ACCEPTANCE
Placing an order constitutes an offer to purchase the selected item.
An order may be subject to payment authorization, fraud screening, inventory verification and other reasonable verification procedures.
Where permitted by applicable law, Stella Sacrum may refuse or cancel an order for legitimate reasons including suspected fraud, unauthorized payment, incorrect pricing, inventory error, inability to verify customer information, shipping restrictions or legal/regulatory requirements.
If Stella Sacrum cancels a fully paid order, the amount paid for the cancelled order will be refunded as required by applicable law.
10. PAYMENT & FRAUD PREVENTION
Customers must provide accurate billing, payment, contact and shipping information.
We may use reasonable fraud-prevention measures and may request additional verification before shipping a high-value order.
Where reasonably necessary to prevent fraud, shipment may be delayed while payment or identity information is verified.
We reserve the right to cancel an order where we reasonably determine that the transaction presents a material risk of fraud or unauthorized payment, subject to applicable law.
11. CHARGEBACKS & PAYMENT DISPUTES
Customers should contact Stella Sacrum promptly if they believe an order is incorrect, unauthorized, damaged, materially different from its description, or otherwise problematic so that we have an opportunity to investigate and address the matter.
Nothing in these Terms restricts a customer from exercising legitimate rights available through their payment provider or under applicable law.
However, knowingly making false representations, falsely claiming non-receipt, submitting materially false information in connection with a payment dispute, or otherwise engaging in fraudulent conduct may result in Stella Sacrum providing relevant transaction, delivery and communication records to the applicable payment provider or other appropriate parties.
12. SHIPPING & DELIVERY
Shipping is governed by our Shipping Policy, which forms part of these Terms.
High-value shipments may require tracking, insurance and/or signature confirmation.
Customers are responsible for providing a complete and accurate shipping address.
Delivery dates are estimates unless expressly guaranteed in writing.
Carrier delays, customs processing, weather events and other circumstances outside our reasonable control may affect delivery.
Our responsibility for lost, damaged or delayed shipments will be determined according to our Shipping Policy and applicable law.
13. INTERNATIONAL ORDERS, CUSTOMS, DUTIES & TAXES
International customers are responsible for complying with applicable import requirements in their destination jurisdiction.
Unless the product listing, checkout or order confirmation expressly states that particular duties, taxes or import fees are prepaid or included, the recipient is responsible for applicable customs duties, import taxes, brokerage fees and governmental charges.
Where Stella Sacrum expressly advertises prepaid U.S. import fees or another prepaid import arrangement, that commitment applies only to the destination and charges specifically identified for that transaction.
Customs authorities may delay or inspect international shipments. Such governmental processing is outside Stella Sacrum’s reasonable control.
14. REFUSED & UNDELIVERABLE PACKAGES
Customers are responsible for providing an accurate and deliverable shipping address and for accepting delivery where reasonably required.
If a package is returned because of an incorrect or incomplete customer-provided address, refusal of delivery, failure to collect the shipment, or failure to satisfy destination-country import requirements, any refund or reshipment will be handled in accordance with our Shipping and Return & Refund Policies and applicable law.
Actual non-refundable shipping, return shipping, customs or carrier charges may be deducted where permitted by applicable law.
15. RETURNS, CANCELLATIONS & FINAL SALE
Returns, cancellations and refunds are governed by our separate Return & Refund Policy.
Certain antique, vintage, one-of-one, customized, altered, resized, reconstructed or otherwise designated items may be Final Sale where permitted by applicable law.
A Final Sale designation does not eliminate any statutory right or remedy that cannot legally be waived.
16. DAMAGE IN TRANSIT
Customers should inspect their order promptly after delivery.
If an item arrives damaged, customers should retain the item, packaging and shipping materials and contact Stella Sacrum promptly with photographs and other reasonably requested information so that we can investigate the shipment and, where applicable, pursue a carrier or insurance claim.
Customers should not discard packaging associated with a claimed transit loss or damage until the matter has been resolved.
17. ALTERATIONS AFTER DELIVERY
Stella Sacrum is not responsible for damage caused after delivery by improper use, accidents, improper storage, inappropriate cleaning, chemical exposure, unauthorized repairs, resizing, soldering, alterations or work performed by a third party, except where liability cannot legally be excluded.
Any third-party modification may materially alter an antique piece and should be undertaken only after consultation with a qualified jeweler.
18. CARE OF ANTIQUE JEWELRY
Antique jewelry requires appropriate care consistent with its age and construction.
Clasps, links, solder joints, gemstone settings and other components may experience wear over time.
Customers should periodically inspect valuable or frequently worn antique jewelry and, where appropriate, have it professionally inspected.
Stella Sacrum does not guarantee that an antique item will remain indefinitely free from future wear, maintenance or repair requirements.
19. INTELLECTUAL PROPERTY
Original Stella Sacrum photographs, videos, product descriptions, graphics, branding, designs, logos and other original content are owned by or licensed to Stella Sacrum.
Such content may not be copied, reproduced, republished, commercially exploited or used to advertise or sell another product without our prior permission, except where permitted by applicable law.
20. PROHIBITED USE
Customers and website users may not use our website or services to engage in fraud, unlawful activity, intellectual-property infringement, malicious interference with the website, transmission of harmful code, collection of information in violation of applicable law, or other unlawful conduct.
21. THIRD-PARTY SERVICES
Our store may rely upon third-party services including Shopify, payment processors, shipping carriers and other service providers.
Certain third-party services may be subject to separate terms and privacy policies.
Stella Sacrum is not responsible for independent acts or omissions of third-party providers except to the extent responsibility cannot legally be excluded.
22. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, and except for representations expressly made by Stella Sacrum or warranties that cannot legally be excluded, products and services are provided subject to the descriptions and conditions disclosed at the time of sale.
Nothing in these Terms excludes, restricts or modifies mandatory warranties, statutory guarantees, consumer rights or remedies that cannot lawfully be excluded.
23. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Stella Sacrum will not be liable for indirect, incidental, special, exemplary or consequential damages arising from use of the website or products.
Where liability may lawfully be limited, Stella Sacrum’s aggregate liability arising from a particular transaction will not exceed the amount actually paid to Stella Sacrum for the product giving rise to the claim.
This limitation does not apply where such limitation is prohibited by applicable law and does not restrict mandatory consumer rights or remedies.
24. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold Stella Sacrum harmless from claims, losses, liabilities or reasonable expenses arising from your unlawful use of our website, fraudulent conduct, violation of these Terms, or infringement of third-party rights.
25. CONSUMER RIGHTS
Nothing in these Terms is intended to waive, restrict or exclude rights or remedies that cannot legally be waived under applicable consumer protection legislation.
Where these Terms conflict with a mandatory provision of applicable law, the mandatory provision will prevail.
For Ontario internet transactions, applicable consumer legislation may require specified pre-contract disclosure, an opportunity to correct errors and accept or decline the transaction, and delivery of a written copy of the internet agreement.
26. GOVERNING LAW
These Terms and transactions with Stella Sacrum are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
This provision does not deprive a consumer of mandatory protections available under laws that apply to that consumer and cannot legally be excluded by contract.
27. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will remain in effect.
28. NO WAIVER
Failure by Stella Sacrum to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or any other right.
29. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes in our operations, services or legal requirements.
The version applicable to a transaction will be the version in effect when the transaction was entered into, subject to applicable law.
30. ENTIRE AGREEMENT
These Terms, together with the product listing, applicable order information, Return & Refund Policy, Shipping Policy, Privacy Policy and other policies expressly incorporated herein, constitute the agreement governing purchases through our website, subject to applicable law.
